As a lawyer myself who drafts contracts for influencers like you, I am giving you all the crucial terms regarding the scoping that you need in your Instagram influencer agreement template.

Key scoping terms any social media management agreement template must have
1. Make the brief part of your contract
When negotiating influencer contracts and the other party presents an Instagram influencer agreement template that does not include the exact brief the deal was made for, this can cause misunderstandings.
I often see either of two cases when the Instagram influencer agreement template does not include the brief:
That contract may include a vague description that is not the same as the brief. That causes confusion about what description you should follow for your content. Does the brand expect you to create what is described in the brief that contains more specific details, the contract which may be interpreted differently, or a combination of both? This can cause discussions when you deliver content based on the brief, contract, and/or both, and the brand has something different in mind.
In other cases, I’ve seen that the contract contains no description at all of the deliverables. That will cause confusion as to whether the brief needs to be followed because that is not what is agreed upon by the contract. In that case, the brand may even ask for completely different content after you have delivered your first drafts, while that is not what you thought you agreed upon.
Therefore, You need to make the brief a part of your contract by:
including the proper references to the brief in your Instagram influencer agreement template to legally make the brief part of your contract, and
including your brief as an annexe to your Instagram influencer agreement template pdf.
That way, the exact scope of the content you need to deliver to the brand is clear to both you and the brand.
2. Create room for deviation from the brief
An issue that may come up when you present your first drafts to the brand is that the content is not exactly what the brand had in mind. However, the content does fit your interpretation of the brief. No matter how specific the brief may be, your interpretation may still differ from the brand’s interpretation of the brief.
Suppose you deliver the drafts to the brand, and the brand rejects the content because the brand argues that it does not conform with the brief. Then, you’ll end up in a discussion over whether or not you have delivered the content. Or, the brand may demand new drafts over and over (without paying you for them because you did not deliver what was agreed upon, according to the brand).
You want to avoid any discussions on whether or not you have delivered content in conformity with the contract.
Also, sometimes, not everything described in the brief is feasible, or you created something better than the brief. And then, the brand may be petty and decide not to pay you because you did not deliver based on the brief.
For all these reasons, your Instagram influencer agreement template should include provisions that clearly state that:
you may deviate from the brief,
you are not in breach of the contract when you deviate from the brief,
your content will still be considered ‘delivered’ according to the contract (and, thus, the brand must pay you), and
you are in no way obligated to compensate the brand for any deviations from the brief.
3. Specify your Instagram handle
The next two important things that must be specified in your Instagram influencer agreement template are:
the platform on which you will post the content, which in this case, is Instagram, and
the Instagram handle of your Instagram account on which the content will be posted.
This is to avoid that the brand expects you to (1) post that same content on your other social media platforms, like TikTok, if you have them, or (2) post the content on other Instagram accounts you may have now or in the future.
4. Describe the types of content
You can post many types of content on Instagram, such as one-image posts, Carousels, Reels, Stories, and live videos.
You do not want there to be any miscommunication about the type(s) of content you will be creating for the brand. Maybe you thought the brand engaged you to create a couple of Stories while the brand wanted you to Go Live or create Reels.
Therefore, your Instagram influencer agreement template needs to have a clause in which you can specify what type(s) of content you will create for the brand.
5. Specify the number for each type of content
If you are creating multiple pieces of content for a brand, you must specify the number of pieces of content for each type of content.
For example, if the brand wants you to create 3 Reels and 2 Stories, you need to specify exactly those numbers and those types of content. Again, you want to avoid any miscommunication about what you will deliver to the brand.
Your Instagram influencer agreement template should include a clause in which you can clearly set out the types of content AND the number for each type of content.
6. Include specifics for your captions
The last thing you need to specify for the content you create is what needs to be included in your captions.
Some brands will be very specific about what you need to write word-for-word, and that may be specified in the brief (which is part of your contract), but they may want to give you free reign to come up with something creative yourself.
In any case, the brand will have a specific link, which you must have in your bio or an Instagram handle of the brand which they want you to tag in your post.
Your Instagram influencer agreement template must include a clause in which you can specify those things so that you can immediately include the correct links, tags and other information for the brand.
7. Specify the number of drafts
That brings me to the next crucial element of your Instagram influencer agreement template: the drafts.
Even if you have specified (1) the brief, (2) your right to deviate from the brief, (3) the type(s) of content, and (4) what’s included in your captions, and you deliver the content in conformity with your contract, some brands will still require changes to be made.
That’s fine if you have to change your first draft(s) slightly. You want the brand to be happy with what you create.
However, if the brand keeps asking for more and more changes, this deal can become a money-drainer instead of a money-maker. You are wasting your precious time and energy on recreating something for this brand that is time and energy you could spend on another brand deal.
Therefore, your Instagram influencer agreement template should include:
the specified number of revision rounds included in the fee, a free revision round for the brand, and
an option for more revision rounds for an additional fee.
That way, you can still create more drafts until the brand is satisfied, but you receive fair compensation.
8. Include fair compensation for deviations
Speaking of fair compensation, your Instagram influencer agreement template should also include the right for you to charge an additional fee if the brand requests changes to the original brief.
Maybe you created something great or started creating content based on the original brief for the brand. But, somewhere during the project, the brand came up with something to add or something completely different. Then, that will ultimately create more work for you.
That’s fine if you get compensated for it, but this is a right you want to have clearly stated in your contract so that there can be no discussions about additional fees you may charge the brand.
Therefore, your Instagram influencer agreement template should include:
the right to charge an additional fee, and
an annexe with the additional fees listed so that there are no surprises for the brand, and, thus, no discussions on (the rate of) additional fees.
9. Include (other) services you do NOT provide
The next extremely crucial part of the scoping terms to be included in your Instagram influencer agreement template is the services and deliverables that are NOT included in the scope.
What you will deliver to the brand may be crystal clear to you. However, the brand may assume that certain services are included in your services, like additional revisions (even if you have specified the number of revisions included in the fee).
Therefore, you want to ensure that both you and the brand are on the same page about what is not included in the scope. That way, you avoid discussion, and the brand can’t become disappointed, thus creating a mutually beneficial relationship with good foundations for future collaboration.
Here are some examples of deliverables and services you want to specify in the Instagram influencer agreement template which are not included in the scope:
publication of (any part of) the content on any other platforms,
copying any existing influencer’s material or style, and
providing any additional revisions, amendments, changes, or edits.
