The 10 must-haves for an effective testimonial release form template free of fluff

Regardless of whether you are using a written, photo, or video testimonial consent form, your testimonial release form template must include the following 10 essentials.

1. Get rights to ALL current and future testimonials & statements

Any testimonial release form template pdf you’ll find on the internet will cover only one testimonial. But that’s a missed opportunity!

Instead, use a testimonial release form template that grants you rights to use:

  • ALL current AND future testimonials the person provides

  • Not just formal testimonials but any other reviews, feedback & statements they make about your brand

  • Social media posts where they rave about your product

  • Emails or texts they later send

  • Reviews & recommendations on their own website about your product or service

With a testimonial release form template that includes all the legal wording to use those statements, you won’t need to request permission repeatedly—you get full rights upfront.

This is where a great testimonial release form template (my template) distinguishes itself from all the other testimonial form examples.

A comprehensive testimonial release form template opens up a lot of opportunities you might not even have considered. Any way that your clients, customers or followers rave about your business on at any time, you get to use!

2. Obtain the rights to use their photo, logo & bio

When showcasing your testimonials, you don’t just want to use the names of those people. People want to see the real persons behinf the testimonials. A random name for you testimonials isn’t enough.

People will only trust your testimonials when they know who the persons behind the testimonials are.

So, you want to include a photo and bio of the person to make them real. But you can’t use someone’s photo or bio without the proper legal rights. Your testimonial release form should grant rights to use:

  • Their photo (for a more personal, relatable testimonial).

  • Their video recording (if the testimonial is included in a video)

  • Their business logo (if applicable)

  • A short bio (to enhance credibility)

Why do I emphasise this? Many release forms you’ll find online will only give you the right to use a person’s name and testimonial but often do not give you the right to also use a photo of them or a video of them.

That’s why it’s important to ensure that your testimonial release form template includes these crucial rights!

3. Make it perpetual non-revocable

You don’t want someone revoking their testimonial months later!

This is why simple permission to use their testimonial does not suffice.

Your testimonial release form template should include a perpetual, non-revocable license. Here’s what it means:

  • ‘Perpetual’ means that there is no end date to the license, which means that you can use their testimonial for however long you want, forever actually.

  • ‘Non-revocable’ means that whoever gave you the testimonial can not suddenly change their mind and demand you take it down. That is unless, of course, you are actually using their testimonial to deliberately harm them in some way (which I assume you won't).

4. Get rights to use testimonials for all purposes (including advertising)

You may only plan to use testimonials on your website now—but what about:

  • Future ads (Facebook, Instagram, Google)?

  • Educational content (showing how people use your product or service)?

  • Demonstrational and promotional purposes (to show others that certain results your client talks about in their testimonial are achievable)

Your testimonial release form template should state that testimonials can be used for any business purpose, ensuring you have the flexibility to use testimonials however you want.

5. Obtain rights to use testimonials anywhere & everywhere

Your testimonial release form must grant a worldwide license so you can use the testimonial anywhere, including:

  • Your website (testimonial pages, product pages, sales pages)

  • Your social media (Instagram, LinkedIn, TikTok, YouTube, Facebook, Pinterest)

  • Your email newsletters

  • Your podcast or other platforms

Even if you don’t use all these platforms now, this ensures you’re covered for the future.

6. Ensure legal compliance: waivers of personality & privacy rights

Using someone’s name, photo, or testimonial (personal data) without explicit waivers can lead to legal claims based on privacy, publicity, or personality rights.

This means you could be violating privacy & publicity laws if you don’t have the proper wording included in your testimonial release form that covers (international) privacy & publicity laws, even if you have the license to use their testimonial (because that only concerns their intellectual property rights).

Thus, ensure your testimonial release form template includes a waiver of these rights so they can’t later demand removal or claim an infringement.

7. Rights to edit, modify & reformat testimonials

Why would you need the right to edit, modify and reformat someone's testimonial? Well, because you likely will! Here are a few examples:

  • When you are publishing someone's full testimonial on your website or cropping their photo, you are literally reformatting their testimonial from an email format.

  • When you quote only one or two sentences from that testimonial in a social media post, that also constitutes a modification.

  • Even small edits—like adjusting font size or formatting—technically edit a testimonial.

That is why your testimonial release form template should include the right to edit, modify and format testimonials.

8. Include consideration (also if you're not paying)

Did you know? For a contract to be enforceable in many countries, there must be “consideration”. It means both parties have to exchange something of value for a contract to be valid and enforceable.

This doesn’t have to be money, just something of value! Something of value could be exposure in exchange for their testimonial.

A proper testimonial release form template must clearly state the (non-monetary) value that the person is receiving for their testimonial. Here’s why:

  • Validity of the contract: A random testimonial release form template pdf you’ll find online will likely only state that the testimonial is given “for good and valuable consideration”, which in court cases has been problematic, as the value received is not described.

  • Avoid claims for money: Another reason is to avoid that person asking you for money if it seems like your sales were boosted due (in part) to that person's valuable testimonial. Especially in the era of UGC creators, if it's a video testimonial, that person could suddenly ask for royalties to keep using their video testimonials.

You want to avoid having to pay or having to take that testimonial down for these reasons.

9. Ensure their testimonial is original (avoid copyright issues)

You don’t want to publish a testimonial that was copied from somewhere else! What if that testimonial was stolen from a competitor’s website?

That is why a testimonial release form template should include:

  • A statement that the testimonial is original and not taken from another source.

  • A waiver and indemnity protecting you from legal claims if the testimonial was copied.

This prevents future copyright infringement claims (from competitors) and disputes over a testimonial.

10. Exclude your liability (protect your business)

Some people change their minds and might later claim their testimonial harmed their reputation.

Or, maybe you later express views in public they do not agree with, and they no longer want to be associated with you and ask for compensation for reputational damages.

A liability waiver prevents them from demanding compensation or removal if they regret their testimonial.

That is why an ironclad testimonial release form template should include a proper limitation of liability under which the person providing the testimonial releases you from all liability in relation to their testimonial.
