9. Zoom Guest Speaker Agreement

Since we left off with contracts for influencers on guesting on YouTube, let’s get into the next contract you will likely need: a Zoom Guest Speaker Agreement.

Not only will you likely be invited to be a guest in a YouTube video, which will be edited later, but you will also be invited to speak at live online events.

Someone who has made it to your level will have expertise that people want to listen to, like in the following examples:

  • Maybe another creator is running a mastermind or a live event, and they want to interview you or have you give a presentation.

  • Or, maybe a business coach or mogul wants you to talk about your specific area of expertise at their online event.

In those cases, you want to be sure to protect yourself with a proper contract for the following reasons:

  • Likely, the live event is recorded, so the host of the online event could repurpose the recording of you for a $5,000 course for which they have never compensated you! Or maybe they want to use part of the video for their own advertising without discussing it with you first. With a solid Zoom guest speaker agreement, you can avoid this risk by agreeing on where the recording may be published and for what purpose it may be used.

  • Maybe there are certain things you do not want to talk about or questions you do not want the host to ask you. With a guest speaker agreement, you can agree on what subjects you will and will not talk about.

  • I’m all about having a clear and transparent process when working together, and I’m sure you do, too. With the proper guest speaker contract template, you can agree on a step-by-step process so that both you and the host are on the same page.

10. (Guest-friendly) Podcast Guest Agreement

Another one of the contracts for influencers you’ll likely need, which has become essential for every influencer over the last few years, is a guest-friendly podcast guest agreement.

Everyone and their mother has a podcast, and they are interviewing all types of entrepreneurs, including influencers. For podcast appearances, you’ll need a special guest-friendly podcast guest agreement to avoid the following risks:

❌ 2-hour long conversations when you have agreed to 30 minutes (your time is valuable, so protect it!)

❌ Part of the conversation being included which you have specifically asked the podcaster to cut out

❌ Social media posts of clips of the interview which take your words completely out of context

❌ Clips of the podcast being used for paid advertising (which you don’t receive any compensation for)

❌ (Part of) the interview being published only on Patreon and not on the free podcast platforms, like Apple Podcast and Spotify (where the podcast has a way bigger audience)

11. (Podcaster-friendly) Podcast Guest Agreement

As I said, almost everyone now has a podcast. If you are starting or have already started your own podcast, you will likely have guests on your podcast, too. In that case, you’ll need a podcaster-friendly podcast guest agreement. Here are the major issues you might face if you don’t have a podcaster-friendly guest contract to protect yourself and your podcast:

❌ If the guest is unhappy with the interview for whatever reason (even if it just concerns 10 seconds of the interview, the guest could force you entirely to remove the episode.

❌ The guest could restrict you from distributing your podcast on podcasting platforms, like Apple Podcast or Spotify, or other platforms, like YouTube and Patreon.

❌ The guest could restrict you from posting clips of the podcast on your social media or for ads.

❌ The guest could request (unreasonable) edits to the podcast or the clips you post on Instagram or TikTok.

❌ The guest could suddenly demand you pay compensation when your podcast does really well.

❌ The guest could sue you for not having requested permission to record first (even though the guest was obviously very willing to be on your podcast).

❌ The guest could sue you for disparagement or reputation damage if they receive any negative feedback from that podcast episode.

❌ You could get sued by your listeners for things your guest said in the episode.

12. Podcast Production Agreement

If you’re running your business on multiple platforms, you don’t have the time to do everything yourself. So, at some point, you’ll likely need to hire a producer for your podcast.

In that case, you’ll need a podcast production agreement to prevent the common issues:

❌ Your podcast could get hijacked by the producer if you have a falling out with your producer.

❌ You could lose access to all your edited episodes if the producer decides to ghost you.

❌ Without any IP protections in place, the producer could become the co-owner of your edited podcast episodes.

❌ The producer could use copyright-protected songs or audio in your podcast episodes, leaving you with major $100M claims from big labels.

❌ You could overpay (with fixed monthly fees) the producer when you miss an episode.

13. Social Media Management Agreement

Another job you may take on as an influencer with a proven track record is social media management.

You probably get DMs all the time from your followers and companies asking you how to grow their accounts.

In that case, you’ll need a social media management agreement to protect your money, energy and time (which you need for other priorities).

With a (SM manager-friendly) social media management agreement, you’ll have the following crucial rights in place:

✅ Clear scoping mechanisms and boundaries so that your clients won’t have any vague or unreasonable expectations.

✅ Complete autonomy in your posting schedule and reporting so that you stay in control of your time and schedule.

✅ A minimum period that your clients must commit to so that they can’t just walk away at the beginning of the process when all your hard work has not come to fruition yet.

✅ Payment mechanisms to ensure you get paid (on time).

✅ Flexibility to adapt your strategies and social media calendars to the unique needs of each client and account and the constantly changing social media landscape.

14. Media Release Form

The next one of the crucial contracts for influencers is a media release form. When creating content for a (sponsored) post or campaign or at an (influencer) event, you will likely have other people in your content.

If they are identifiable, meaning you could see who this person is (and the face is not blurred out), you need permission to use that content. Otherwise, you could be faced with the following issues:

❌ That person could force you not to delete that content from your platforms.

❌ You could be faced with claims for breach of publicity and privacy laws.

❌ That person could demand compensation (when they find out you made money with that content).

15. (Client-friendly) Freelance Agreement

Another one of the essential contracts for influencers is a (client-friendly) freelance or independent contractor agreement for your team.

As your business grows, you’ll also start growing a team to help you run your business, such as assistants and editors.

For those members of your team, you’ll want to have a client-friendly freelance agreement for the following reasons:

  • You’ll have the proper IP provisions in place to ensure you will receive and keep full ownership of all intellectual property the freelancer creates for you.

  • You’ll probably hire people in other States or countries to work with you virtually. The proper freelance agreement should provide you with legal armour so that you can not be dragged to court in a different country or state.

  • You’ll be sharing sensitive (business) information with them, so you’ll want comprehensive protections in your contracts that provide you with complete protection of that information.

  • Hopefully, every single person you hire will be a star at what they do and always deliver on time. However, if you’re dealing with a bad apple or sloth, you don’t want to still be obligated to pay them when they don’t deliver (on time). A client-friendly freelance agreement will provide you with the right to suspend payments or not pay at all if the freelancer does not deliver.

  • The proper contract will also provide you with critical protections you need to avoid penalties to authorities due to mistakes made by the freelancer or employment taxes.

Bonus: Custom-made contracts for special events

I’ve already started this blog post with live online events, but as your business grows, you might want to host live in-person events yourself or even host a getaway (maybe together with another creator)!

These kind of events have multiple moving parts that require different contracts for influencers, such as the following:

  • Terms and conditions for the event or getaway tickets, which your attendees must agree to

  • A joint venture agreement if you’re hosting this event or getaway together with someone else

  • An event planning agreement if you’re hiring an event planner
